İSTANBUL FOTOĞRAF YARIŞMASI
GENEL KATILIM ŞARTLARI VE YARIŞMA ŞARTNAMESİ
- Seçici kurul (jüri) üyeleri ile Yarışma Organizasyonu temsilcileri yarışmaya katılamaz. Yarışma, 18 yaşını doldurmuş, amatör veya profesyonel fotoğrafçılığa ilgi duyan herkesin katılımına açık, uluslararası bir yarışmadır.
- Yarışma; dijital veya analog (film) kameralarla çekilmiş Renkli veya Siyah-Beyaz fotoğrafları içeren tek bir kategoriden oluşmaktadır. Tüm dijital ve/veya dijitalleştirilmiş Renkli ve Siyah-Beyaz fotoğraflar birlikte değerlendirilecektir. Analog kameralarla yapılan başvurular için, yüksek çözünürlüklü dijital taramalar üretilmeli ve sisteme buna göre yüklenmelidir.
- Her katılımcı yarışmaya dilediği sayıda Renkli veya Siyah-Beyaz fotoğrafla katılabilir.
- Yarışmanın tarafsızlığını ve şeffaflığını sağlamak amacıyla, seçici kurul üyeleri değerlendirme sürecinde katılımcıların isimlerini, unvanlarını veya biyografilerini görmeyecektir. Tüm ön eleme ve nihai değerlendirmeler tamamen anonim olarak gerçekleştirilir (kör değerlendirme sistemi).
- Sadece sokakta ve kamusal alanlarda (sokaklar, meydanlar, parklar, toplu taşıma araçları vb.) anlık ve kurgulanmamış (candid) yöntemlerle çekilmiş fotoğraflar kabul edilir. Önceden planlanmış, model veya oyuncu kullanılarak kurgulanmış ya da yapay ışık sistemleri kullanılarak sokakta sahnelenmiş fotoğraflar diskalifiye edilecektir.
- Katılımcılar gönderdikleri fotoğrafların telif haklarına sahip olmalıdır. Fotoğraflarını göndererek bu haklara sahip olduklarını onaylamış sayılırlar. Katılımcı, yarışmaya sunulan eserin tamamen kendisine ait olduğunu ve gerekli tüm izinlerin alındığını kabul, beyan ve taahhüt eder. Ödül kazanan ancak daha sonra bu beyan ve kabule aykırı davrandığı tespit edilen katılımcılar yarışmadan diskalifiye edilir ve kazanılan ödül iptal edilir. Değerlendirme kurulunu yanıltmak amacıyla, sunulan bir fotoğraf üzerinde kendisine ait olmayan bir eseri kendi eseri gibi göstermek için herhangi bir müdahale veya değişiklik yapan katılımcılar da jüri kararıyla yarışmadan diskalifiye edilir.
- Yarışma Organizasyonu, gerekli görmesi halinde katılımcılardan fotoğrafların/görsellerin orijinal (yüksek çözünürlüklü raw) dosyalarını talep edebilir. Ödül ve sergileme aşamasına gelen finalist eserlerin özgünlüğünü doğrulamak için, seçici kurul veya organizasyon; dijital çekimler için orijinal RAW dosyasını veya düzenlenmemiş ilk JPEG dosyasını, analog çekimler için ise orijinal negatif/pozitif film şeridinin (veya dijital kontakt baskısının) yüksek çözünürlüklü görselini talep etme hakkını saklı tutar. Talep edilen doğrulama materyallerinin organizasyon tarafından belirtilen süre içinde (örneğin 5 iş günü) sunulmaması doğrudan diskalifiye nedenidir.
- Başka bir yarışmada daha önce ödül almış bir fotoğrafla katılım mümkündür. Fotoğrafın bu yarışma dışında ödül almış, sergilenmiş veya yayınlanmış olması katılımına engel teşkil etmez.
- Fotoğrafta katılımcı veya çekim bilgilerini içeren herhangi bir işaret, tarih, isim, logo veya başka bir ibare bulunmamalıdır.
- Yarışmaya gönderilecek dijital fotoğraflar, her yarışma için belirtilen boyut ve dosya boyutlarında JPG/JPEG, HEIF veya HEIC formatında kaydedilmelidir. Fotoğrafçılar yükleme yapmadan önce bu gereksinimi test etmelidir. Katılımcı tarafından yüklenen fotoğrafların yukarıda belirtilen boyut ve dosya sınırları, yükleme anında sistem tarafından kontrol edilir ve otomatik olarak gerekli uyarılar verilir; uygun olmayan fotoğraflar yüklenemez. Fotoğrafların belirtilen boyut ve ebatlarda yüklenmesi tamamen katılımcının sorumluluğundadır.
- Gönderilen fotoğrafların kadrajında yer alan kişilerin, fotoğraflarının çekilmesine, bir yarışmaya gönderilmesine ve görsel, yazılı medya, sosyal medya ile internette yayınlanmasına izin verdikleri kabul edilir. Bu tür kullanımlardan doğabilecek tüm hukuki anlaşmazlıklardan kaynaklanan sorumluluk tamamen katılımcıya aittir.
- Kazanan eserler Yarışma Organizasyonunun resmi web sitesinde yayınlanacaktır.
- Bu şartnamede belirtilmeyen durumlarda veya uyuşmazlık halinde Seçici Kurul (Jüri) kararları geçerlidir.
- Fotoğraflara uygulanan renk ayarlamaları, keskinleştirme, toz alma, kontrast ayarları gibi belirli işlemler ve kabul edilebilir düzeyde fotoğrafik müdahaleler makul kabul edilir. Analog çekimler için standart karanlık oda düzeltmeleri (pozlama, maskeleme vb.) ve tarama sırasında oluşan dijital tozların giderilmesi kurallara uygundur. Kadrajın tamamındaki veya belirli bir bölgesindeki mevcut renkler ve desenler başka renk ve desenlere dönüştürülemez. Kamera içi uygulamalar veya harici yazılımlar kullanılarak birden fazla görüntünün birleştirilmesiyle oluşturulan tekil yeni fotoğraflar, eserin belgesel niteliğine müdahale ettiği için kabul edilemez. Her türlü yapay zeka (Generative AI) tarafından üretilen veya değiştirilen fotoğraflar yarışma kapsamı dışında kabul edilecek ve diskalifiye edilecektir. Parazit azaltma (noise reduction) amaçlı standart yazılım araçları bu kısıtlamanın dışındadır. Yarışmada seçici kurulun kararı nihai karardır.
- Birden fazla görüntünün montajlanması/birleştirilmesiyle oluşturulan fotoğraflar yarışmaya kabul edilmez.
- Markalar, şirketler ve kişiler fotoğraf içeriğinde saldırgan veya aşağılayıcı bir şekilde tasvir edilemez. Çocukların, mültecilerin veya savunmasız toplulukların haklarını ihlal eden, onları istismar eden veya insan onuruna aykırı unsurlar barındıran fotoğraflar diskalifiye edilecektir; çekim sırasında doğaya veya canlılara zarar verdiği tespit edilen eserler de yarışma dışı bırakılacaktır.
- Yarışma Organizasyonunun sistemine yüklenen fotoğrafların EXIF bilgileri (çekim tarihi, DPI, piksel detayları gibi) bozulmamış, değiştirilmemiş ve silinmemiş olmalıdır. Analog çekimlerde tarama dosyasının teknik detayları esas alınır. Aksi takdirde, sistem içinde meydana gelebilecek herhangi bir teknik sorundan Yarışma Organizasyonu sorumlu değildir.
FİKRİ MÜLKİYET VE TELİF HAKLARI
Fotoğrafların mali/ekonomik hakları katılımcılarda kalmakla birlikte; katılımcı, 5846 sayılı Fikir ve Sanat Eserleri Kanunu'nda tanımlanan işleme (Madde 21), çoğaltma (Madde 22), yayma (Madde 23), temsil (Madde 24) ve kamuya iletim (Madde 25) mali haklarını; organizasyonun bu yarışma ve gelecekteki benzer yarışmalarla ilgili duyurular, reklamlar ve benzeri amaçlarla kullanabilmesi için yurt içinde veya yurt dışında her türlü mecrada süresiz ve ücretsiz olarak kullanma hakkını Yarışma Organizasyonuna devreder. Yukarıda belirtilenlere bakılmaksızın katılımcı; dereceye giren, mansiyon alan veya sergilenmeye değer görülen eserler için, Yarışma Organizasyonuna bu yarışmanın tanıtımı, sergiler, web sitesi/sosyal medya paylaşımları, gelecekteki yarışma duyuruları ve basılı albüm/kataloglarla sınırlı olmak üzere yerel ve uluslararası tüm mecralarda ticari olmayan amaçlarla kullanılması için münhasır olmayan bir kullanım izni verdiğini kabul eder. Yarışma Organizasyonu bu hakları katılımcının adını belirterek kullanabilir.
Katılımcı, bu koşullarla ilgili olarak, özellikle 5846 sayılı Fikir ve Sanat Eserleri Kanunu'ndan doğabilecek olası talepler konusunda Kurumumuzdan herhangi bir hak veya alacak talebinde bulunmayacağını kabul ve beyan eder ve yukarıda belirtilen tanıtım bağlamı kapsamında fikri mülkiyet haklarına ilişkin dava veya talep haklarından geri dönülemez şekilde feragat etmiş sayılır.
Yarışmaya eser gönderenler, eserlerin kendilerine ait olduğunu veya yukarıda belirtilen gerekli izinlerin/telif haklarının alındığını kabul, beyan ve taahhüt etmiş sayılırlar. Yarışma Organizasyonu, katılımcıların fotoğraflarına ilişkin izinler ve telif hakları konusunda hiçbir sorumluluk kabul etmez. Katılımcı; gönderilen eserdeki telif hakları, ticari markalar veya kişilik haklarının ihlalinden kaynaklanan üçüncü şahıs talepleri, davaları, itirazları ve zararlarına karşı Yarışma Organizasyonunu tamamen muaf tutacağını, tazmin edeceğini ve organizasyonun bu nedenle uğrayacağı maddi/manevi zararlar ile olası mahkeme/avukatlık ücretlerini koşulsuz olarak karşılayacağını kabul, beyan ve taahhüt eder. Yarışma Organizasyonu doğabilecek hukuki veya ticari anlaşmazlıklarda taraf değildir.
Yarışma sonuçları (Ödüller ve sergilenecek fotoğraflar) Yarışma Organizasyonunun web sitesinde ve sosyal medya hesaplarında (Facebook, Instagram, Twitter ve benzeri platformlar) yayınlanacaktır. Ayrıca sonuçlar, Yarışma Organizasyonu tarafından ödül kazanan veya sergileme hakkı elde eden katılımcılara bildirilecektir.
Fotoğrafçı, eserin kendi özgün çalışması olduğunu, üçüncü şahısların bu eser üzerinde herhangi bir hakkı bulunmadığını, eserin kullanım/hukuki haklarının kendisine ait olduğunu ve üçüncü şahısların aksi yöndeki iddiaları durumunda yasal olarak sorumlu olduğunu beyan, kabul ve garanti eder.
Fotoğrafta tasvir edilen kişilerin çekime izin verdikleri, fotoğrafların bir yarışmaya gönderileceğini ve görsel, çevrimiçi ve basılı mecralarda yayınlanacağını bildikleri ve onayladıkları kabul edilir. Kadrajda şahısların, şirketlerin ve markaların yer almasından doğan yasal sorumluluk tamamen fotoğrafçıya aittir; Yarışma Organizasyonu doğabilecek hukuki veya ticari sorunlarda taraf değildir. Yarışmacı, fotoğraf gönderdiğinde bu şartları kabul etmiş sayılır. Katılımcı, bu tür kullanımlardan doğan anlaşmazlıklardan tek başına sorumludur.
Katılımcılara ait kişisel veriler (ad, soyad, e-posta, telefon vb.); 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve uluslararası veri koruma düzenlemelerine uygun olarak, yalnızca yarışmanın yürütülmesi, değerlendirilmesi, sonuçlarının duyurulması ve organizasyonel güncellemelerin gönderilmesi amaçlarıyla işlenecek, saklanacak ve üçüncü şahıslarla paylaşılmayacaktır.
Yarışmaya katılan tüm yarışmacılar, bu şartnamedeki yarışma koşullarına uymayı kabul etmiş sayılırlar.
ESERLERİN SİSTEME YÜKLENMESİ VE BİLGİLERİN TAMAMLANMASI
- Since the competition will be conducted via an online photography system, no alternative submissions (e-mail, cargo/mail, hand delivery, etc.) will be accepted. / Yarışma çevrimiçi bir fotoğraf sistemi üzerinden yürütüleceğinden, alternatif hiçbir başvuru yöntemi (e-posta, kargo/posta, elden teslim vb.) kabul edilmeyecektir.
- Yarışma fotoğraflarının çevrimiçi gönderimi, https://istanbulfotofestival.com/contest/ adresindeki fotoğraf gönderme talimatları takip edilerek gerçekleştirilecektir.
- Yarışma başvurularına ilişkin diğer tüm teknik detaylar https://istanbulfotofestival.com adresinde yer almaktadır.
- Çevrimiçi kayıt veya katılım sürecinde sistemden veya kullanıcıdan kaynaklanan hataların oluşması durumunda, tuncugurdag@me.com adresi üzerinden bildirim yapılması kaydıyla sorun kısa sürede çözülecek ve katılımcı bilgilendirilecektir. Yarışmacılar, eserlerin yüklenmesinden kaynaklanabilecek olası sorunlardan İTO SEYAHAT ORGANİZASYONU LTD ŞTİ'nin hiçbir sorumluluk taşımadığını kabul ve beyan ederler.
- Doğal afetler, salgın hastalıklar, genel şebeke/altyapı kesintileri, savaş veya organizasyonun kontrolü dışındaki mücbir sebeplerin ortaya çıkması durumunda, Yarışma Organizasyonu yarışma takvimini değiştirme, erteleme veya yarışmayı tamamen iptal etme hakkını saklı tutar.
ISTANBUL PHOTO CONTEST
GENERAL TERMS AND CONDITIONS OF PARTICIPATION AND COMPETITION SPECIFICATIONS
- Members of the selection committee (jury), and members/representatives of the Competition Organization are not eligible to participate. The competition is an international contest open to anyone over the age of 18, whether amateur or professional, who is passionate about photography.
- The competition consists of a single category that includes Color or Black-and-White photography shot with either digital or analog (film) cameras. All digital and/or digitized Color and Black-and-White photographs will be evaluated together. For submissions shot with analog cameras, high-resolution digital scans must be produced and uploaded to the system accordingly.
- Each participant may enter the competition with as many Color or Black-and-White photographs as they wish.
- To ensure the impartiality and transparency of the competition, selection committee members will not see the names, titles, or biographies of the participants during the evaluation process. All pre-selection and final evaluations are conducted entirely anonymously (blind judging system).
- Only photographs taken on the street and in public spaces (streets, squares, parks, public transport vehicles, etc.) using spontaneous and unposed (candid) methods are accepted. Photographs that are pre-planned, staged using models or actors, or staged on the street using artificial lighting systems will be disqualified.
- Participants must hold the copyrights to the photographs they submit. By submitting their photographs, they are deemed to have confirmed these rights. The participant accepts, declares, and undertakes that the work submitted to the competition belongs entirely to them and that all necessary permissions have been obtained. Participants who win an award but are later found to have acted contrary to this declaration and acceptance will be disqualified from the competition, and any award won will be revoked. Participants who perform any intervention or modification on a submitted photograph to present a work that does not belong to them as their own, thereby intending to mislead the evaluation committee, will also be disqualified from the competition by the decision of the jury.
- The Competition Organization may, if it deems necessary, request the original (high-resolution raw) files of the photographs/images from the participants. To verify the authenticity of the finalist works that reach the award and exhibition stage, the selection committee or the organization reserves the right to request the original RAW file or the unedited first JPEG file for digital shots; and a high-resolution image of the original negative/positive film strip (or digital contact sheet) for analog shots. Failure to submit the requested verification materials within the period specified by the organization (e.g., 5 business days) constitutes a direct ground for disqualification.
- Participation is permitted with a photograph that has previously won an award in any other competition. The fact that the photograph has received an award, been exhibited, or been published outside of this competition will not prevent its participation.
- The photograph must not contain any marks, dates, names, logos, or any other signs containing participant or shooting information.
- Digital photographs to be submitted to the competition must be saved in JPG/JPEG, HEIF, or HEIC format, in the dimensions and file sizes specified for each competition. Photographers must test this requirement before submitting. For the photographs submitted by the competitor, the aforementioned dimensions and file sizes are checked by the system at the time of upload, and necessary warnings are given automatically; non-compliant photographs cannot be uploaded. Uploading the photographs in the specified dimensions and sizes is the sole responsibility of the participant.
- It is accepted that the people visible within the frame of the submitted photographs have given permission for their photograph to be taken, to be submitted to a competition, and to be published in visual and printed media, social media, and on the internet. All responsibility for any disputes that may arise from such use belongs entirely to the competitor.
- The winning works will be published on the official website of the Competition Organization.
- In cases not covered by these specifications or in the event of disputes, the decisions of the Selection Committee shall apply.
- Certain processes applied to photographs such as color adjustments, sharpening, dust removal, contrast settings, and an acceptable degree of photographic intervention are considered reasonable. For analog shots, standard darkroom corrections (exposure, dodging/burning, etc.) and the removal of digital dust generated during scanning are compliant with the rules. Existing colors and patterns across the frame or in a specific region cannot be converted into other colors or patterns. Single new photographs created by merging multiple images using in-camera applications or external software are unacceptable, as this interferes with the documentary nature of the work. Photographs generated or modified by any form of artificial intelligence (Generative AI) are considered outside the scope of the competition and will be disqualified. Standard software tools for noise reduction are excluded from this restriction. The decision of the selection committee is final in the competition.
- Photographs created by montage/compositing multiple images are not accepted into the competition.
- Brands, companies, and individuals cannot be depicted in a offensive or derogatory manner in the content of the photograph. Photographs that violate the rights of children, refugees, or vulnerable communities, exploit them, or contain elements contrary to human dignity will be disqualified; works found to have caused harm to nature or living creatures during the shoot will also be excluded from the competition.
- The EXIF information (such as shooting date, DPI, pixel details) of the photographs uploaded to the Competition Organization's system must be intact, unaltered, and un-deleted. For analog shots, the technical details of the scan file shall be taken as the basis. Otherwise, the Competition Organization is not responsible for any technical issues that may occur within the system.
INTELLECTUAL PROPERTY AND COPYRIGHTS OF THE PHOTO COMPETITION
Although the financial/economic rights to the photographs remain with the participants, the participant hereby transfers the financial rights—concerning processing as defined in Article 21, reproduction as defined in Article 22, distribution as defined in Article 23, representation as defined in Article 24, and communication to the public as defined in Article 25 of the Intellectual Property and Artistic Works Law No. 5846—to the Competition Organization for an indefinite period and free of charge, in any media domestic or international, so that the organization can use them for announcements, advertisements, and similar purposes related to this competition as well as future iterations or similar competitions. Notwithstanding the foregoing, the participant agrees that for works that place, receive an honorable mention, or are deemed worthy of exhibition, they grant non-exclusive permission to the Competition Organization to use such works for non-commercial purposes across all local and international media, strictly limited to the promotion of this competition, exhibitions, website/social media posts, future competition announcements, and printed albums/catalogs. The Competition Organization may use these rights by crediting the participant's name.
The participant accepts and declares that they have no claims or receivables from our Institution regarding these terms, particularly concerning any potential demands that may arise from the Intellectual Property and Artistic Works Law No. 5846, and they are deemed to have irrevocably waived any rights to file claims or lawsuits regarding intellectual property rights within the scope of the aforementioned promotional context.
Those who submit works to the competition are deemed to have accepted, declared, and undertaken that the works belong to them or that the necessary permissions/copyrights mentioned above have been obtained. The Competition Organization accepts no responsibility regarding permissions and copyrights for the participants' photographs. The participant accepts, declares, and undertakes that they will indemnify and hold the Competition Organization completely harmless against any third-party claims, lawsuits, objections, and damages arising from violations of copyrights, trademarks, or personality rights in the submitted work, and will unconditionally compensate any material/moral damages and potential court/attorney fees incurred by the organization due to this reason. The Competition Organization is not a party to any legal or commercial disputes that may arise.
The results of the competition (Awards and photographs to be exhibited) will be published on the website of the Competition Organization and its social media accounts (Facebook, Instagram, Twitter, and similar platforms). In addition, the results will be notified by the Competition Organization to the participants who have won an award or the right to be exhibited.
The photographer declares, accepts, and guarantees that the work is their own original work, that third parties have no rights over this work, that the usage/legal rights of the work belong to them, and that the photographer is legally responsible in the event of an opposing claim by third parties.
It is accepted that the individuals depicted in the photograph have consented to the shoot, and know and approve that the photographs will be sent to a competition and published in visual, online, and printed media. The legal responsibility arising from the inclusion of individuals, companies, and brands within the frame belongs entirely to the photographer; the Competition Organization is not a party to any legal or commercial problems that may arise. The competitor is deemed to have accepted these terms when submitting a photograph. The competitor is solely responsible for disputes arising from such uses.
Personal data belonging to the participants (name, surname, e-mail, telephone, etc.) will be processed, stored, and will not be shared with third parties, in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK) and international data protection regulations, solely for the purposes of conducting, evaluating, announcing the results of the competition, and sending organizational updates.
All competitors participating in the competition are deemed to have agreed to comply with the competition terms in these specifications.
UPLOADING WORKS TO THE SYSTEM AND COMPLETION OF INFORMATION
- Since the competition will be conducted via an online photography system, no alternative submissions (e-mail, cargo/mail, hand delivery, etc.) will be accepted.
- The online submission of competition photographs will take place by following the photo submission instructions at the address: https://istanbulfotofestival.com/contest/.
- All other technical details regarding applications to the competition can be found at the address: https://istanbulfotofestival.com.
- In the event of errors arising from the system or the user during the process of registering or participating online, the problem will be resolved shortly and the participant will be informed, provided that notification is sent via the address: tuncugurdag@me.com. Competitors accept and declare that İTO SEYAHAT ORGANİZASYONU LTD ŞTİ bears no responsibility for potential problems that may arise from the uploading of the works.
- In the event of natural disasters, pandemics, general network/infrastructure outages, war, or any force majeure events beyond the control of the organization, the Competition Organization reserves the right to modify the competition schedule, postpone, or completely cancel the competition.
